Following the Environmental Damage (Prevention and Remediation) Regulation passed in 2009, the polluter is now to be deemed liable to pay costs for damage(s) caused to water, land and biodiversity. Additional information regarding this legislation can be found via the links below:

This legislation insists on businesses becoming more environmentally aware and responsible. Purchasing Environmental Impairment Liability insurance (EIL) or Pollution Liability insurance will now at least need to be a consideration in all forms of businesses across the following:

  • Site purchase
  • Site development
  • Manufacturing and industrial plants
  • Storage
  • Property ownership

Cover arrangements remain both plausible and possible for sites where contamination is already known to exist, including landfill sites.

Wordings available for this cover type vary significantly. It is important to understand, not only what this policy delivers on day one, but how it will develop during the course of the term. Also, how the policy can be endorsed and/or extended should your development/plant/operation change from its initial direction.
